Jerry Lee Clark Case - Alabama Free Speech Violation


  • Alan Thomas presented case of Jerry Clark in Shelby County, Alabama

  • Clark moved into home in blood red conservative area, is not conservative himself

  • Placed "Never Trump" / "Trump is a Clown" sign on his property using old real estate sign

  • Neighbors began harassing him: driving onto property, recording grandchildren, stopping at early morning hours

  • Police refused to help and told him to take sign down (First Amendment violation)

  • Clark added barbed wire, chains, and 55 gallon drums labeled "warning contains explosives" (actually fireworks) as deterrent

  • Clark pointed laser pointer at harassers and out-of-jurisdiction police who were stalking him at 1-3 AM

Alan explained the escalation: "As they escalate, he escalates. And it ultimately amounts to him receiving an involuntary commitment order."


Involuntary Commitment and Charges


  • Clark received involuntary commitment order based on "reports of weapons" and "access to multiple firearms, explosives, and other weapons"

  • Locked up since June in Shelby County Jail

  • Cleared by psychiatrists after seven days

  • While in involuntary commitment, given Haldol (antipsychotic) and Depakote (seizure medication/mood stabilizer)

  • While on these medications, signed waiver of rights to attorney

Michael explained the medication effects: "Haldol's known as a Phenothiazine, it's an old school anti-psychotic... These are called, they're called, they're classified as major tranquilizers."


Alan described the state of those on these drugs: "if you'll think back to the movie, one Flew Over the Coco's Nest... all the people laying in chairs just laying around, drooling on themselves. That's typical reaction to being on these medications."


Criminal Charges Against Clark


  • Two counts of harassment

  • One count of reckless endangerment

  • One count of unlawful manufacturer of destructive device, bacteriological or biological weapon in first degree

  • Two counts of possession, manufacturer, transport, or distribution of destructive device

  • Charges based on legally purchased fireworks ($300 worth) with phone app remote detonator

  • Total bail: $403,000 cash only (originally $200,000, then changed to cash only when family brought equity)

Michael provided comparison: "I was charged with conspiracy to assault one, conspiracy to burglary, one hindering prosecution, reckless endangerment... three second degree assaults... carrying a handgun without a permit and possession of heroin with intent to sell and possession of crack cocaine with intent to sell. My bail was $500,000 and was not cash only."


Procedural Violations in Clark Case


  • State secured involuntary commitment without family member petition

  • Police from City of Helena patrolled area 10 miles outside their jurisdiction

  • Bail amount doubled and changed to cash only after family attempted to post bond

  • Clark has suffered suspected stroke in jail with no medical attention

  • Weight loss from size 40 to size 32

  • Supposed biweekly 30-minute family visits mostly denied

  • First visit with wife was on Christmas day

  • DA offering plea deals requiring guilty plea to multiple felonies (removing voting rights and appeal rights)

Alan outlined the rights violations: "Shelby County, Alabama, the local police department and his neighbors are violating Mr. Clark's first, second, and Fourth Amendment rights."


Alabama Prison System Context


  • HBO Max documentary "Alabama Solution" recommended

  • Overcrowding and severe understaffing

  • Medical system outsourced to local hospitals (many closing)

  • Facilities over 100 years old without updates since 1930s-40s

  • No heat in winter, no air in summer

Alan described conditions: "500 men in a concrete room. With no bars, no barriers, no cots sleeping on floors."
